NOTICE TO CREDITORS
In the Insolvent Estate of David ARNOT Junior, of Colesberg
All persons claiming to be Creditors under this Estate are required to take notice, in terms of the [56th] section of Ordinance No.6 of 1848, and in a pursuance of a resolution of the Creditors on the 10th inst, that a General Meeting of the Creditors is hereby called, and will be held before the Resident Magistrate of Port Elizabeth at his Office on Saturday the 14th day of July 1855, at 11 o’clock in the forenoon, for the purpose of finally considering and deciding on two Provisional Resolutions passed at the Second Meeting, relative to a propose allowance of the Insolvent, and his retention of certain household furniture; also for the purpose of determining the time and mode of sale; and the terms and conditions of sale of the household furniture and all of the landed property both in and out of the colony; also for the further proof of debts, and the examination of the Insolvent, and generally for the purpose of giving additional directions to the Trustee as to the administration of the Estate.
And all persons indebted to the Estate are again cautioned that they are required to pay the same to the Trustee forthwith, or legal proceedings will be instituted against them.

PORT ELIZABETH MINING COMPANY
Notice is hereby given that the Company’s Scrip is now ready to be delivered to the Shareholders at the Office in Main-street, Port Elizabeth.
Shareholders who have neglected to sign the Trust Deed, or made default in payment of the Third instalment, are required to take notice that after the 17th day of July next the terms of the 7th Section of the Trust Deed will be strictly enforced.

On Wednesday last the mournful intelligence of the sudden death, by accident, of our esteemed fellow townsman Mr. D. McDONALD Sen., was received here. It appears that deceased was in a cart in company with his son, Mr. Surveyor McDONALD, on his way from Smithfield to Bloemfontein, when at about 30 miles from the former town, as they were descending a rather rugged hill, the pole of the cart broke, the horses took fright and sped down the hill, throwing Mr. McDONALD violently from the cart, which was entirely smashed, and occasioning serious concussion of the brain, from which cause he expired in about fifteen hours afterwards. Mr. McDONALD was conscious, we are told, to the last, and met his death with great resignation, only expressing as soon as his situation was made known to him the agonising wish that he could have seen those in this world whom he so loved before he was taken for ever from them.

And all Persons indebted to the said Estate are required to pay the same to the Undersigned forthwith, or proceedings will be instituted against them.

Our obituary of today records the death of the esteemed Civil Commissioner of Cradock, the late Mr. GILFILLAN. The following notice of this loss to the public service is from the pen of our own correspondent, and we can ourselves join with him not only in the sentiment that Mr. GILFILLAN died without an enemy, but carrying with him the esteem of all who knew him [lines obscured in fold of paper]

Mr. GILFILLAN, our respected Magistrate, is dead. He had been indisposed for some eight or ten days, and was confined to his bed on the occasion of His Excellency’s visit to this place last week, but up to Monday last no serious consequences were apprehended; however, on the evening of that day an unfavourable change took place, and on Tuesday morning he expired. The funeral took place on Thursday afternoon, which was attended by almost every person in town, both white and black. Mr. GILFILLAN was nearly sixty years of age and had been Resident Magistrate of this place for about eighteen years, during which period, it may be said, that he discharged his various duties to the best of his abilities, and that he died without an enemy. It is to be hoped that Government, or whoever’s business it may be to fill up this magisterial vacancy, will be careful in the selection, and not thrust upon the inhabitants of this large and important Division a person that is not in every sense qualified for the duties; in a word, no incapable must be appointed. Communicated.
